Terms for Website Design Townsville clients
These terms for Website Design Townsville set out how I work with clients in plain English. Your written quote sets out the specific price, inclusions and payment terms for your job.
Who they apply to
Website Design Townsville is a sole trader business run by Nick Fritzkowski. In these terms “I” and “me” means Nick and “you” means the client.
These terms apply to all website builds, SEO, Google Ads management, hosting help and updates and support work. If anything in your written quote is different from these terms, the quote applies.
Fixed prices in writing
Every quote is in writing and is valid for 30 days from the date it is sent. Website quotes are fixed prices with GST included unless the quote says otherwise.
A quote covers the work listed in it. If you ask for extra pages, features or changes beyond the agreed scope, I will let you know the cost before doing the extra work.
As set out in your quote
The deposit and balance terms for each job are set out in your written quote. Work starts once the deposit has been paid. The balance is due as described in the quote, usually before the site goes live on your domain.
Invoices are sent by email and are payable within the time shown on the invoice.
Photos, text and logos you supply
You are responsible for making sure any text, photos, logos and other material you supply are yours to use or that you have permission to use them.
Delays in supplying content can push out the launch date. If a project stalls for a long time while waiting on content, I may invoice for the work completed so far.
Your site is yours once paid
Once your website has been paid for in full, you own the site, its content and your domain name. Hosting accounts are set up in your name, so you control them.
Some themes and plugins are licensed rather than owned and remain subject to their own licence terms. I may show the site in my portfolio unless you ask me not to.
Paid directly to the provider
Some costs are paid to other companies and are not part of my fees. These are kept in your name and paid by you.
Month to month with no lock in
Local SEO, Google Ads management and updates and support plans run month to month. You can cancel at any time by giving 30 days notice by email.
Monthly fees are paid in advance. Results from SEO and Google Ads depend on many things outside my control, such as competition and Google’s own changes, so I cannot promise specific rankings or numbers of leads.
Reasonable limits
I take care with every job, but I am not responsible for losses caused by things outside my control. That includes hosting outages, third party plugin faults, changes made by Google or problems caused by changes you or others make to the site.
To the extent the law allows, my liability for any claim is limited to the amount you paid me for the work in question. Nothing in these terms removes any rights you have under Australian Consumer Law.
Queensland law applies
These terms are governed by the laws of Queensland, Australia.
